Terms of Service

These terms are an agreement between you and Kerr Digital Marketing, LLC (“we” or “us”), of Colorado, United States, covering your use of Sales Floor Pro. An application creates no account and no paid commitment. If invited, you must actively select unchecked clickwrap boxes for the current version before using product routes. If you do not agree, please do not use the app.

What Sales Floor Pro is

Sales Floor Pro is a tool for automotive salespeople to track follow-ups, customers, deals and pay, referrals, review requests, and gifts. It is software you use to do your own job. It is not a dealership system of record, and it does not replace whatever CRM your employer requires.

Features under development

The app is actively being built, and some areas are labelled as coming soon or are limited on purpose. In particular, features that would post to social networks or send messages through outside providers are not connected to those services yet: what you schedule or draft is saved in your account, and nothing is published or sent on your behalf until the relevant integration is live and you connect it.

We would rather say this plainly than let a label imply something the app does not do. Do not rely on an unfinished feature for anything that matters to your income until it is confirmed working.

Your account

• You must be at least 18 years old.
• Give accurate account information and keep your password private. You are responsible for what happens under your account.
• Accounts are for one person. Do not share logins — the app separates data by account, and sharing defeats that.
• Tell us promptly at justin@salesfloorpro.app if you think someone else has access.

Your data and your customers

You keep ownership of what you put into the app. We store and process it to provide the service, as described in the Privacy Policy.

Because you enter information about other people, you agree that you have a proper basis to hold it, and that you will follow the laws and dealership policies that apply to contacting customers — including consent and do-not-call rules for calls and texts. You are responsible for the messages you send, including any the app helps you compose. The app does not obtain consent for you.

Acceptable use

Do not:

• use the app to send unsolicited or unlawful messages;
• upload someone else’s customer list that you have no right to hold, or take data from an employer’s system in breach of your agreements with them;
• store government identifiers, financial account numbers, credit applications, or health information in notes;
• try to reach another account’s data, probe or bypass security controls, or disrupt the service;
• scrape, resell, or redistribute the app, or build a competing product out of it;
• post content through the app that is unlawful, harassing, or deceptive.

We may suspend or close an account that breaks these rules, ideally after telling you why.

Pricing and paid features

Starter Pilot requires no credit card and carries no paid commitment. Paid modules are not currently offered. If that changes:

• we will tell you before a feature you are relying on becomes paid;
• prices and billing terms will be shown before you are charged;
• nothing will be charged to you without you agreeing to it first.

If you subscribe through the Apple App Store or Google Play, that store handles billing, renewals, and refunds under its own terms, and you can manage or cancel the subscription in your store account.

Our intellectual property

The app, its design, and its name belong to us. These terms give you permission to use the app; they do not transfer ownership of it.

Availability

We aim to keep Sales Floor Pro running and backed up, but we do not promise uninterrupted service. We may change, suspend, or discontinue features. If we plan to discontinue something you depend on, we will give you reasonable notice and a way to export your data.

Ending your account

You can stop using the app at any time and ask us to delete your account by emailing justin@salesfloorpro.app. We may close an account for a serious or repeated breach of these terms, or if we stop offering the service. Deletion is covered in the Privacy Policy.

Disclaimers

The app is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows.

Pay tracking is a personal record-keeping tool. Its figures are only as accurate as what you enter and how you configure your pay plan. It is not a payroll system, not tax advice, and not a substitute for your dealership’s official pay statement. Always check your actual pay against your employer’s records.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost deals, or lost data. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

Indemnity

You agree to cover our reasonable losses arising from your misuse of the app or your breach of these terms, including claims about how you contacted a customer or how you obtained their information.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Disputes will be heard in the state or federal courts located in Colorado, and we each consent to those courts. If you are a consumer, this does not remove rights you have under the law of the place you live.

Changes to these terms

We may update these terms. If a change materially affects you, we will update the date below and notify you in the app or by email before it takes effect. Continuing to use Sales Floor Pro after that means you accept the updated terms.
